How to Cultivate a Positive Mental Attitude in the Legal Profession

As a retired NYS Supreme Court Judge, I’ve seen firsthand how a positive mental attitude can change the course of not just a case, but a career. Whether you’re navigating the courtroom or climbing the corporate legal ladder, one truth remains constant: your mindset matters. Bo Bennett once said, “Having a positive mental attitude is asking how something can be done rather than saying it can’t be done.” This powerful quote perfectly encapsulates the key to success in any profession, especially law.

In the legal world, where challenges and setbacks are inevitable, it’s easy to focus on obstacles. Whether it’s a tough case, a difficult client, or feeling overwhelmed by the sheer volume of work, the temptation to say, “this can’t be done” can be strong. However, it’s precisely in these moments that a shift in mindset makes all the difference.

The Power of “How?”

The beauty of Bennett’s quote lies in its simplicity—it’s all about asking the right questions. Instead of accepting defeat, ask yourself, “How can I turn this around?” or “What can I do differently to achieve a better outcome?”

When I started my legal career, I faced many moments where the odds seemed stacked against me. As someone who came to the U.S. with limited English skills and little financial support, it would have been easy to say, “This can’t be done.” But instead, I kept asking myself how I could move forward, and each answer opened new doors. That mindset allowed me to go from being a non-English speaker to presiding over cases as a judge in the New York State Supreme Court.

How to Cultivate a Positive Mental Attitude

  1. Embrace Problem-Solving: A positive mental attitude is rooted in your approach to challenges. Rather than focusing on why something won’t work, focus on solutions. When faced with adversity, ask yourself, “How can I solve this?”
  2. Stay Curious: Curiosity fuels growth. Continually seek out new ways to approach problems, and don’t be afraid to think outside the box. This is especially important in the legal field, where creative problem-solving can often be the key to winning cases or resolving conflicts.
  3. Surround Yourself with Positivity: Your environment impacts your mindset. Surround yourself with people who inspire and uplift you. Whether it’s a mentor, a colleague, or a supportive friend, having a positive circle reinforces your own attitude.
  4. Learn from Setbacks: In law, as in life, setbacks are inevitable. The key is to view them as learning opportunities rather than roadblocks. Ask yourself what you can learn from each experience and how it can make you stronger.
  5. Celebrate Wins, Big and Small: Acknowledge your progress. Whether you’ve won a high-profile case or simply mastered a new legal skill, celebrating your achievements fuels your motivation and strengthens your positive mindset.

Transforming Challenges into Opportunities

As attorneys, we are constantly faced with what seems like impossible situations. Instead of seeing these as roadblocks, a positive mental attitude encourages us to see them as opportunities for growth. By asking how something can be done, rather than concluding that it can’t, we open ourselves to new possibilities and solutions that might have been overlooked.

In the end, your mental attitude is one of the few things you have complete control over. By cultivating a mindset that embraces possibility over limitation, you set yourself up for success not just in law, but in life.

I encourage you to keep asking yourself, “How can this be done?” and watch as new doors open and challenges transform into opportunities.
